Your privacy is important to us. This privacy policy describes how Vringo, Inc ("Vringo") treats certain information provided by you in connection with your access to and use of the Vringo website (the "Service"). Information contained in or provided with Content (as that term is defined in the Vringo Terms of Use) that you upload, transmit, post or otherwise make available using the Service is not covered by this Privacy Policy.

This privacy policy is incorporated into and is subject to the Vringo Terms of Use. If you do not agree to the terms of this privacy policy or the Vringo Terms of Use, do not provide Vringo with any information and do not use the Service. This privacy policy may be modified by Vringo in its sole discretion at any time without prior notice to you. We will post any revised privacy policy on the Service. Your continued use of the Service after the privacy policy has been modified and posted will signify your acceptance of such modifications for information provided by you.

Information we collect
We may collect personal information about you in connection with your use of the Service. Such information may include your name, address, telephone number, email address, IP address, biographical information and other personally identifiable information belonging to you. We may collect such information when you register with the Service and in connection with your transactions with us and some of our business partners. You can add or update certain information by clicking on the account settings link. When you update information, we usually keep a copy of the prior version for our records.

Our servers may automatically receive and record information about you on our server logs. We may use "cookies" containing anonymous unique identifiers stored on your computer. We may let our advertisers set and access their cookies on your computer. Our advertisers do not have access to our cookies. However, (i) personal information you share with Vringo may be used by us for any purpose including, without limitation, to enhance the user experience, to share with business counterparties, or otherwise, all subject to Vringo's sole discretion, and (ii) personal information you include in Content that you upload, transmit, post or otherwise make generally available using the Service may be viewed by others and is not subject to this privacy policy, and you may receive unsolicited messages as a result. In addition, when you post a message, your user id or alias may be viewed by others.

We may use cookies to assist in keeping track of your preferences and user settings, estimate and report our total number of users and usage traffic, and help us improve the content and services provided in connection with the Service. We may use your IP address to diagnose and prevent or resolve technology problems, estimate the number of users from certain geographic areas or monitor and prevent abuse of the Service. When you send post a video, your IP address may be displayed to the owners or maintainers of certain journals or blogs.

We may use or share your personal information where it is necessary to complete a transaction, to operate or improve the Service or to do something that you have asked us to do. We may use your personal information internally to assist us in categorizing or contextualizing advertising content, and we may share aggregated, non-personal information (which does not identify you individually), such as the number of users who viewed or clicked on a particular advertisement.

We make efforts to implement commercially reasonable data security measures on our systems that are designed to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. However, no data transmissions over the Internet can be guaranteed to be secure. As a result, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

Information relating to children
Vringo does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information from persons under 13 years of age, and no part of our website is directed to persons under 13. If you are under 13 years of age, then please do not use or access the Service at any time or in any manner. If Vringo learns that personally identifiable information of persons under 13 years of age has been collected without verified parental consent, then Vringo will take the appropriate steps to delete this information.

Special Note to International Users
The Service is primarily hosted in the United States and is intended for and directed to users in the United States. If you are a user accessing the Service from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the Service, which are governed by U.S. law, this Privacy Notice, and the Vringo Terms of Use, you are transferring your personal information to the United States and you consent to that transfer.

In the Event of Merger, Sale, or Bankruptcy
In the event that Vringo is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.
